7/5/14 - Type of deployment: drew - aimed - pointed laser

Suspect surrendered upon mere display of CEW

A Patrol Sergeant spotted a subject riding a scooter on the sidewalk, who had 836 PC to arrest pursuant to a San Rafael PD Domestic Violence investigation. The Sergeant knew the subject from previous contacts and knew him to resist law enforcement in the past. The subject is also known to be a Mixed Martial Artist. When the Sergeant attempted to detain the subject, the subject fled on his scooter. One additional Deputy arrived to join in the apprehension of the subject. The subject then picked up his scooter and a foot pursuit ensued. A Deputy finally caught up to the subject and was able to take him to the ground. The subject continued to resist on the ground and ignored commands to put his hands behind his back. The Sergeant deployed his CEW, turned it on, pointed the laser at the subject, and ordered him to stop resisting and to place his hands behind his back. The subject then complied and was safely taken into custody.

A subject forcibly pushed an 86 year old victim to the ground and stole $1,200 in cash from his wallet. The subject was identified from a photo line- up and was well known to Marin City Deputies. The subject’s sister knew he was wanted in relation to the crime, and called MCSO to inform them that the subject was inside her residence in Marin City. The sister then exited the residence with her kids, prior to MCSO arrival. She later informed arriving Deputies that her brother was not aware that she had called the Sheriff’s Office. When a Deputy knocked on the door, the wanted subject opened the door, saw that it was law enforcement, and quickly closed the door. Deputies set up a perimeter around the residence and tried to negotiate with the subject. A canine officer arrived on scene and informed the subject that the canine was going to be deployed in the residence. After approximately 20 minutes, the subject opened the door. Several Deputies instructed the subject to put his hands up while holding the subject at gunpoint. One Deputy was designated to be the CEW operator. This Deputy deployed his CEW, turned the device on, and pointed the laser at the subject. The subject complied with Deputies’ orders, and was safely taken into custody.

A Deputy was on routine patrol in Marin City when he saw a subject he knew from previous contacts. The Deputy had briefing information that the subject was to be arrested per 836 PC, for an armed robbery with a firearm that had recently occurred in the city of Ross. The Deputy approached the subject who was wearing a large black duffel bag across his chest. The duffel bag was concealing the subject’s hands and the Deputy did not know if the subject was still in possession of the firearm used in the robbery. The subject began to slowly walk away from the Deputy. The Deputy ordered the subject to stop and to show his hands. The Deputy told the subject that if he did not comply he could be “tased”. The subject then began to run away from the Deputy. The Deputy deployed his CEW and fired one cartridge at the subject as he ran away. Both probes missed the target. The Deputy then lost sight of the suspect. The suspect was then located a short distance away and safely taken into custody.

  • Offense: 10851 CVC – Vehicle Theft, 148.9 PC – False Information to a Peace Officer

At 0400 hours, a Patrol Deputy responded to assist a Tiburon Police Officer with an occupied vehicle investigation. The vehicle was occupied by a male and a female. When the Deputy arrived on scene, the TPD Officer advised him that the vehicle was parked in front of a construction zone and that the male driver was giving him a name that did not have a match in CLETS. The driver also could not spell his first name when asked to provide a spelling. The Sheriff’s Office and TPD had been recently having a rash of construction site burglaries. When the TPD officer asked the subject to step out of the vehicle to continue his investigation, the subject refused to do so, and attempted to start his vehicle while reaching under his seat for an unknown item. A physical struggle ensued between the TPD officer and the subject. During the struggle, the TPD officer deployed his pepper spray (OC) on the subject. The spray did not immediately have its desired effect, and the subject was able to get his vehicle started. In attempt to keep the subject from fleeing the scene, and possibly using his vehicle as a weapon against responding officers, the Patrol Deputy deployed his CEW, and fired one cartridge at the subject seated in the car. Only one probe hit the subject in the shoulder and the CEW did not have its desired effect. The subject fled in his vehicle and a pursuit ensued. The subject later crashed his vehicle and was taken into custody. Suspected stolen property was located in the trunk of the vehicle, and the vehicle was unreported stolen out of San Rafael. The subject’s true identity had multiple warrants out for his arrest.
