San Rafael Creek Fatality Identification Release

On Monday April 23rd at approximately 6:42 pm, San Rafael Police responded to a possible burglary in progress in the 300 block of Pt. San Pedro Road.  Two officers went to the residence and contacted a man in the driveway that was behind a security gate.  The man decided to run away from the officers and then jumped into the canal in an attempt to swim away from the officers.  The man slipped below the water surface and did not come back up.

 At approximately 7:46 pm, the subject was located unresponsive and unconscious below the water surface, where he was recovered from the waterway and his death was pronounced.  Coroner Investigators were called to the scene and completed an external examination of the subject.  Coroner Investigators located items of that were stolen from the residence within in his clothing,  in addition to drug paraphernalia, speculated illicit substances, and burglary tools.

The decedent has been identified as:

Albon Eckard WAGENER, 48-year-old male resident of San Francisco

A forensic post mortem examination and toxicology testing have been scheduled to be completed.  The cause and manner of death will be pending toxicology results and the conclusion of the investigation by Marin County Sheriff’s Office.  No further information will be released by the Coroner Division at this time, as this is an active and ongoing investigation.  Any further questions regarding the incident should be directed to Lieutenant Steve de la O of the Marin County Sheriff’s Office.
