Stolen Firearm in School Zone- Subject Arrested

Marin County Specialized Investigative Unit (SIU) arrests Diontae Sol Burton, age 18 of San Rafael, with stolen firearm in school zone.

In January of 2023, a San Rafael resident filed a report with San Rafael Police Department that their Glock 34 pistol had been stolen from their residence.


Several months later, detectives of the Marin County Specialized Investigative Unit (SIU) began receiving information that Diontae Sol Burton, age 18 of San Rafael, may have been in possession of a Glock firearm. Upon further investigation Detectives suspected the firearm to be the reported stolen Glock 34 pistol. 


In May of 2023, detectives had gathered enough evidence to obtain a search warrant for Burton. Burton did not maintain a permanent residence, requiring detectives to locate his whereabouts.


On May 25th 2023 at approximately 1500 hours, SIU detectives received information that Burton was in the area of Woodland Avenue and Lindaro Street in San Rafael. Detectives conducted surveillance in the area and eventually observed Burton emerge from a residence near James B. Davidson Middle School.

 

Burton was detained by SIU detectives as he walked down Woodland Avenue towards downtown San Rafael, approximately 350 feet away from the middle school. Burton had a green fanny pack on his person, which contained the stolen Glock 34 pistol.

 

Burton was booked at the Marin County Jail for possession of a loaded, concealed  firearm in a public place, possession of firearm in a school zone, and possession of stolen property. Burton's bail was set at $100,000 at time of booking.
