Residential Burglary- Taser Deployed

On Monday, 11/6/2023, just after 0730 hours, Deputies were dispatched to an audible alarm at a residence located in the 500 block of Atherton Ave, Novato. A Deputy arrived on scene and located a subject, later identified as Darly Cruz (46 yr old, transient male) exiting the residences side gate, attempting to leave the scene, while carrying multiple bags. Deputies attempted to detain Cruz in order to investigate the alarm and potential burglary. Cruz continued to try and leave the area, collecting a nearby bicycle and not following Deputy commands to stop. Novato Police Department was requested for assistance. After numerous statements made by Cruz that the Deputy would have to shoot him, he turned away from the Deputy and attempted leave the scene down the driveway. The solo Deputy on scene utilized a Taser 7 Conducted Energy Weapon (CEW) to prevent any violence and Cruz’s evasion.


After taking Cruz into custody, was found to be in possession of jewelry and various items from the home, including a "front door key" which opened the residence. Novato Police Department assisting in searching the residence for additional suspects and determined the home had been ransacked, including multiple jewelry boxes scattered throughout the residence and fresh boot prints leading out the rear sliding door, towards the side yard where Cruz had exited from.


Cruz was booked at the Marin County Jail for 459 PC-Burglary, 148.9 PC- False ID to Peace Officer, and 148(a)(1) PC- Resist Obstruct Peace Officer. Cruz was later determined to be a Parolee at large and booked for a parole violation 3056 PC.
